Payment

Payment
The prices are generally exclusive of shipping costs. All prices shown do not include VAT in accordance with § 19 (1) UStG.
The purchase price is due immediately with the order. The item remains the property of the seller until full payment has been made.
Unless otherwise agreed, the amount to be paid by the customer must be paid to the seller within seven days of purchase. After expiry of this payment period, the customer shall be in default of payment. Default of payment does not occur if the customer is not responsible for the characteristics giving rise to the delay.
If no payment has been made after 14 days, the seller reserves the right to cancel the sale and sell the item elsewhere.
The customer can make the payment by PayPal, against advance payment (bank transfer) or by cash on delivery. The customer will receive the seller's bank details after completion of the order.
Set-off rights of the customer are excluded, unless the claim against the seller is undisputed or legally established.
The assignment or pledging of claims or rights existing by the customer against the seller is excluded without the consent of the seller, unless the customer proves a legitimate interest in the assignment or pledging.
The ordered goods will only be shipped after the full amount has been credited to the seller's account.
In the case of payment by cash on delivery, the customer shall only pay cash to the post office/parcel service upon delivery of the goods. When paying by cash on delivery, in addition to the shipping fee, there is an additional 2.00 euro transfer fee and 2.00 euro cash on delivery fee, which are borne by the customer.

For international customers:

Postage costs will be recalculated in the case of collective orders in favor of the buyer.

All products and works offered as well as images, texts, graphics, animation files and scripts in the online shop are subject to copyright protection and may not be copied, reproduced or published in whole or in part without the express consent of the seller.

Product description, screen display
The images used to describe the goods are sample photos. These do not always represent the article lifelike, but serve as an illustration.
Depending on the screen used, colors and sizes in particular can be displayed differently. The description of the respective article is decisive.
Slight deviations from the screen display are also due to the individual production and no reason for complaint.

Our offers are subject to change and non-binding. The contract between the Purchaser and the Seller shall only be concluded by an order placed by the Purchaser and its acceptance by the Seller.
The conclusion of the contract for the Dawanda website is governed by § 7 of the General Terms and Conditions of Dawanda for the use of the Dawanda websites. Order process and delivery times

Claims for defects, warranty
If there is a defect in the purchased item, the customer may first demand removal of the defect or subsequent performance from the seller. If the supplementary performance fails, the customer can withdraw from the contract, reduce the purchase price or claim damages. Withdrawal is excluded if the defect is insignificant.
Unless otherwise stated below, further claims of the customer are excluded.
The seller is not liable for damage that has not occurred to the delivery item itself; in particular, it shall not be liable for loss of profit or for other financial losses of the customer. Insofar as the seller's liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

The same applies if the customer does not have a general place of jurisdiction in Germany or the EU or if his place of residence or habitual residence is not known at the time the action is brought. The right to appeal to the court at another statutory place of jurisdiction remains unaffected by this.
The contract language is German.

Place of performance and jurisdiction
The place of performance for all obligations arising from the contractual relationship is Dortmund. With regard to merchants and legal entities under public law, the place of jurisdiction is Dortmund as agreed.

Final provisions
Should one or more provisions of these GTC be invalid, this shall not entail the invalidity of the entire contract. The invalid provision shall be replaced by the relevant statutory provision.
